1. ObjectThese Terms and Conditions of Sale and Use (hereinafter "T&C") govern all relationships between
Propulse, operated by
Imperivm Marketing FZCO, and any individual or legal entity (hereinafter "the Client") subscribing to the proposed services (hereinafter "the Services").
Acceptance of the T&C is mandatory for any use of the Services.
2. Services offeredPropulse offers digital services for optimization and management of visibility on social networks (Instagram, TikTok, etc.).
The Services are provided
remotely only and consist of implementing means to promote the visibility of the Client's account.
No quantified results or performance guarantee is promised.
3. Absence of right of withdrawal and refund policyIn accordance with article L221-28 of the Consumer Code,
the Client does not benefit from a right of withdrawal due to the digital nature of the Services provided.
No refund will be made, except if
Propulse is unable to operate the service on the Client's account.
The fact that the Client does not obtain the expected results
is not a reason for refund.
Any attempt at
fraudulent bank dispute (chargeback) will result in the immediate opening of a fund recovery file.
4. Financial terms4.1. Subscriptions- The amount due is automatically debited at the chosen frequency during subscription.
- The Client must keep their
Payment Data up to date.
- In case of payment default, Propulse reserves the right to suspend the Services and initiate a
recovery procedure through a mandated company, including direct contact with the Client's bank.
5. Client obligationsThe Client undertakes to:
- Respect the rules of use of platforms (Instagram, TikTok, etc.).
- Provide accurate and up-to-date information.
- Maintain a valid password and access to their social account.
- Not use the Services for illegal activities or contrary to public order.
6. TerminationThe Client can terminate at any time by sending
an email to support@propulse.me.
Termination will only take
effect from the
receipt and validation by Propulse of a satisfaction questionnaire completed online by the Client.
If the questionnaire is not completed, the termination request will be considered incomplete and the subscription will continue until the current due date.
Any termination sent
less than 24h before the renewal date cannot prevent the charge.
7. Limitation of liabilityPropulse provides a
duty of means and not of result.
We are not responsible for:
- Suspension or deletion of the Client's account by a third-party platform.
- Performance variations due to changes in algorithms or social network rules.
- Indirect losses, loss of earnings or image damage.
8. Force majeureIn case of force majeure (international network failure, regulatory prohibition, war, natural disaster, API suspension by a social network, etc.), Propulse cannot be held responsible for the temporary or permanent interruption of the Services.
9. Intellectual propertyAll elements of the site and Services are protected by copyright and remain the exclusive property of Propulse.
10. Personal dataThe management of personal data is described in the
Privacy Policy, available on our site.
11. Applicable law and jurisdictionThe T&C are subject to
FRENCH law.
In case of dispute, exclusive jurisdiction is attributed to the courts of the jurisdiction of Propulse's registered office.
12. AcceptanceBy subscribing to the Services, the Client acknowledges having read, understood and accepted these T&C.
